SUBSTITUTE TRUSTEE’S SALE OF VALUABLE FEE-SIMPLE PROPERTY
708 NORTH DIVISION STREET

Under and by virtue of the power of sale contained in a certain mortgage from Eric R. Sessoms to Deri B. Jeffers, Trustee, and recorded among the Land Records of Wicomico County, Maryland, in Liber M.S.B. No. 2795, Folio 350, and which is more particularly referred to in an Order to Docket Foreclosure filed in the Circuit Court for Wicomico County, Maryland, in Civil Case No. 22-C-10-000118, the holder of the indebtedness secured by the mortgage having appointed Robert A. Eaton Substitute Trustee by instrument duly executed, acknowledged and recorded among the Land Records of the County aforesaid, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Substitute Trustee will offer for sale, at public auction

All that lot of ground situate in the County of Wicomico, State of Maryland, and known as 708 North Division Street, Salisbury, Wicomico County, Maryland, and as more particularly described in the mortgage above referred.
BEING in all respects the same land conveyed unto Eric R. Sessoms, as sole owner, from Jeffrey T. Vernon, individually and as Partner, and from The Estate of Richard James Vernon, by deed recorded among the Land Records of Wicomico County, Maryland.
The property will be sold in an “as is” condition and subject to conditions, restrictions and agreements of record affecting the same, if any, and with no warranty as to the description of the improvements.
Terms of Sale: The successful purchaser shall be required to make a deposit of Five Thousand Dollars ($5,000.00) which will be required at time of sale, such deposit to be in cash, certified check or in other form as the Substitute Trustee may determine acceptable, in his sole discretion. If the noteholder is the successful bidder, it shall be exempt from the terms of sale set forth herein. Time being of the essence. Balance to be paid in cash within ten (10) business days of the final ratification of sale by the Circuit Court for Wicomico County, unless said period is extended by the Substitute Trustee. If payment of the balance does not take place within the specified period stated, in addition to any other legal or equitable remedies available to him, the Substitute Trustee will declare the entire deposit forfeited and resell the property at the risk and cost of the defaulting purchaser. In such event, the defaulting purchaser shall be liable for the payment of any deficiency in the purchase price, all costs and expenses of both sales, attorneys’ fees and all other charges incurred by the Substitute Trustee. Interest to be paid on the unpaid purchase money at the rate pursuant to the mortgage note from date of sale to the day the funds are received in the office of the Substitute Trustee. In the event settlement is delayed for any reason and the property is purchased by someone other than the noteholder, there shall be no abatement of interest caused by the delay. Taxes, ground rent, water rent, Condominium fees and/or Homeowners Association dues, if applicable, shall be adjusted to the date of sale and assumed thereafter by the purchaser. All other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges, to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. The Substitute Trustee reserves the right to reject any and all bids, withdraw the property from sale, postpone and advertise the property for sale at a later date. Neither the Substitute Trustee nor any other party guarantees or covenants to deliver or to in any way obtain possession of the premises for any purchaser. In the event the property is occupied by tenants, the Substitute Trustee assumes no responsibility for security deposits or other monies paid by the tenants to anyone. Cost of all documentary stamps and transfer taxes, and agricultural transfer tax, if any, and all settlement charges shall be borne by the purchaser. If the sale is not ratified or if the Substitute Trustee is unable to convey title for any reason, the purchaser’s sole remedy in law or equity shall be limited to the refund of the deposit to the purchaser. Upon refund of the deposit, this sale shall be void and of no effect and the purchaser shall have no further claim against the Substitute Trustee or the noteholder. This sale is subject to post-sale audit of the status of the loan secured by the mortgage, including, but not limited to, determining whether prior to sale a forbearance, repayment or other agreement was entered into or the loan was reinstated or paid off; in any such event this sale shall be null and void and purchaser’s sole remedy shall be return of deposit without interest. The purchaser at the foreclosure sale shall assume the risk of loss for the property immediately after the sale. The property is sold in “AS IS” condition without express or implied warranty or representation, including, but not limited to, description, fitness, use for a particular purpose, construction, environmental condition, zoning, habitability, merchantability and/or compliance with building codes or other laws. The Substitute Trustee, his attorney and/or noteholder shall not be liable individually or otherwise for any matters relating to this sale or the property.
