Pursuant to a Decree of the Circuit Court of Wicomico County, Maryland, Civil Case Number 22-C-07-000351 the undersigned Substitute Trustee will offer for sale at public auction

DESCRIPTION: ALL that lot or parcel of land situate, lying and being in the City of Salisbury, in Parsons Election District, Wicomico County, State of Maryland, being located along and binding upon the Easterly side of Naylor Street, having a frontage thereon of sixty (60) feet, more or less, extending back therefrom at a uniform width to a depth of ninety-six (96) feet, more or less, SAVING AND EXCEPTING therefrom any land that may have been conveyed to the City of Salisbury for sidewalk and/or road purposes; AND BEING ALL AND THE SAME property that was conveyed unto Tibor David, Jr. and Kara D. David, his wife, by deed dated March 31, 2006, and duly recorded among the land records for Wicomico County, Maryland in Liber M.S.B. 2581, Folio 458, et seq.
TERMS OF SALE: A deposit of Five Thousand Dollars ($5,000.00) will be required of the Purchaser at the time and place of sale in the form of cash, certified or cashier’s check, or other form of security, at the sole discretion of the Substitute Trustee, the balance to be secured to the satisfaction of the Substitute Trustee. 2.5% Buyer Premium to be added to the bid price. Balance in cash due at settlement, which settlement shall be no more than thirty (30) days after final ratification of sale by the Circuit Court of Wicomico County unless said period is extended by the Substitute Trustee, his successors or assigns for good cause shown, time being of the essence. The property will be sold subject to all restrictions, liens, covenants and encumbrances of record. Taxes, water charges, wastewater charges, assessments and liens or encumbrances for sewer, water, drainage, or other public improvements completed or commenced on or prior to the date of sale or subsequent thereto, if any, are to be adjusted and apportioned as of date of sale and are to be assumed and paid thereafter by Purchaser, whether assessments have been levied or not as of date of settlement. Costs of all documentary stamps, transfer taxes, document preparation and title insurance shall be borne by the Purchaser. If Purchaser fails to pay the balance of the purchase price following ratification of the sale, the deposit shall be forfeited and the property resold at the risk and cost of the defaulting Purchaser. If the Substitute Trustee is unable to convey good and marketable title to the property, the Purchaser’s sole remedy at law or in equity shall be limited to the refund of the deposit to the Purchaser. Upon refund of the deposit, this sale shall be void and of no effect, and the Purchaser shall have no further claim against the Substitute Trustee. The land and improvements are being sold in an “AS IS” condition, with no warranties expressed or implied; risk of loss passes to Purchaser at date of sale.
The Substitute Trustee reserves the right to reject any and all bids in his sole discretion.
