SHERIFF'S SALE OF VALUABLE REAL PROPERTY

Pursuant to a Writ of Execution issued in Case No. 22-C-09-001683 in the Circuit Court for Wicomico County, Maryland, I have levied upon, seized and attached as Sheriff of Wicomico County, Maryland, all of the right, title, claim, estate and interest in and to the following parcel of real estate:

ALL that lot of ground and the improvements thereon located at 1000 Phillips Ave, Salisbury, MD, and more particularly described as follows: ALL that lot or parcel of land situate and lying in the City of Salisbury, Parsons Election District, Wicomico County, State of Maryland, on the southerly side of and binding upon Phillips Avenue, and on the Easterly side of and binding upon Priscilla Street, and more particularly described as follows: Beginning for the outlines of the same at a point formed by the intersection of the South line of said Phillips Avenue and with the East of said Priscilla Street at an iron pipe: (1) thence South 86 degrees 30 minutes East, by and with the South line of said Phillips Avenue, a distance of 88.2 feet to an iron pipe and the land now or formerly owned by Leroy Smith, Jr.; (2) thence South 01 degrees 15 minutes West by and with said Smith land, a distance of 70 feet to the Northwest corner of the land now or formerly owned by Bessie Pinto Trader, at an iron pipe; (3) thence a distance of 88 feet to a concrete post of the East side of said Priscilla Street; (4) thence North 01 degrees 06 minutes East by and with said Priscilla Street, a distance of 70 feet to the place of beginning. IT BEING the same property which conveyed by deed dated September 24, 2008, and recorded October 1, 2008, in the Land Records of Wicomico County, Maryland, in Liber 2971, Folio 600.

I hereby give public notice that on TUESDAY, MAY 25, 2010 at 1:05 p.m., I will offer for sale at public auction at the Circuit Court for Wicomico County, North Division Street entrance, Salisbury, Maryland, all of the right, title, claim, estate and interest in and to the aforesaid real estate

TERMS OF SALE: The successful bidder(s) purchases all of the right, title, claim, estate and interest of the judgment debtor. The parcel has not been surveyed, so no representation or warranty can be made regarding acreage, and neither is there any representation being made as to title or the condition of the land or improvements. The successful bidder(s) at the Sheriff’s Sale will take the property in its “AS IS” and “WHERE IS” condition, with all faults and defects of any kind, with no representations or warranties of any kind, including any warranty of merchantable title. Buyers are encouraged to satisfy themselves concerning any issues of title, condition or acreage prior to sale.

A deposit of $5,000.00 will be required to be tendered in CASH OR CERTIFIED CHECK ONLY, at the time and place of sale, with the balance to be paid in the form of a Confessed Judgment Note, bearing an interest rate of twelve percent (12%) per annum, and all due and payable within fifteen (15) business days following final ratification of the sale by the Circuit Court for Wicomico County, Maryland, payable to the Order of the Sheriff of Wicomico County. (In the event that the successful bidder is a Corporation or other limited liability entity, the Confessed Judgment Note shall be co-signed by all principals of the entity.) The Buyer shall be responsible for all settlement costs, including, but not limited to, title examination, if any, recording costs, documentary stamps, transfer tax, and document preparation. If payment of the balance does not take place within the specified time, the property will be resold at the risk and expense of the Buyer. All real estate taxes, charges and assessments will be adjusted as of the date of sale and closing shall take place on or before fifteen (15) days after final ratification of the sale by the Circuit Court for Wicomico County, Maryland, time being of the essence. The right to possession shall pass to the Buyer at closing, subject to any liens of record. The successful bidder purchases all rights, title and interest of the judgment debtor.

The Sheriff makes no representations or warranties, either expressed or implied, with respect to ownership of, condition of, or title to the property or improvements thereon, or as to the suitability of the property for any particular purpose, and shall have no liability with respect to any matter involving the sale.
